“The United States Attorney is the representative not of an ordinary party to a controversy, but of a sovereignty whose obligation to govern impartially is as compelling as its obligation to govern at all; and whose interest, therefore, in a criminal prosecution is not that it shall win a case, but that justice shall be done. As such, he is in a peculiar and very definite sense the servant of the law, the twofold aim of which is that guilt shall not escape nor innocence suffer. He may prosecute with earnestness and vigor—indeed, he should do so. But, while he may strike hard blows, he is not at liberty to strike foul ones. It is as much his duty to refrain from improper methods calculated to produce a wrongful conviction as it is to use every legitimate means to bring about a just one.” Berger v. U.S., 295 U.S. 78, 88 (1935).

The Prosecuting Attorney is elected to a four-year term.

Responsibilities of the Prosecuting Attorney include the prosecution of all crimes that violate state laws, ranging from traffic tickets to homicide.  The office has exclusive jurisdiction over all felony crimes committed in Adair County and misdemeanor offenses which occur in the unincorporated areas of the county.

The Prosecuting Attorney serves as Legal Counsel for Adair County in all matters of the law and advises the county in all manners in which the county may have an interest.

Represents the county in claims against the county and draws contracts relating to business of the county.

The Prosecuting Attorney does not prosecute local city ordinances.

Victim Services: Meets with victims of crimes to insure they understand the prosecution process and coordinates any plea bargain cases before court appearances.

Child Support: Enforces Child Support obligations and prosecutes non-payment.

Victim Services: Meets with victims of crimes to insure they understand the prosecution process and coordinates any plea bargain cases before court appearances.
